These General Conditions of Sale apply to all orders placed on the Website "http://www.miel-des-abeilles.com" (hereinafter referred to as "the Site").
These General Conditions of Sale are concluded on the one hand between:

And, on the other hand,
- By any natural or legal person wishing to make a purchase or booking of an internship via the Website «http://www.miel-des-abeilles.com».
Hereinafter referred to as “Buyer”, “Customer” or “You”
The parties agree that their relations will be governed exclusively by this agreement, excluding any conditions previously available on the Site. However, if a condition were to fail, it would be considered to be governed by the practices in force in the distance selling sector of which the companies are based in France. The Customer acknowledges that, prior to placing the order, he has read all the aforementioned information and the General Conditions of Sale.
Article 1 – Purpose Scope
These General Conditions of Sale are intended to define the contractual conditions (Rights and Obligations) between the company Miel-des-abeilles.com and the Buyer, whether professional or consumer, in the context of the sale of products by the company Miel-des-abeilles.comdes-abeilles.com made through its merchant website: meil-des-abeilles.com.
This contract complies with the French regulations in force, and more particularly with Law 2004-575, known as the Law for Confidence in the Digital Economy. It is also in line with OECD recommendations in the field of electronic commerce, as well as with the provisions of the Châtel Law that came into force on 1 June 2008 and the Hamon Law that came into force on 13 June 2014.
Important: This contract consists of these General Terms and Conditions and the purchase order.
Term of application and amendments to the General Conditions of Sale
These General Conditions of Sale are valid from 20 November 2019.
The honey-bee company reserves the right to adapt or modify these General Conditions of Sale at any time and without notice. In case of modification, it will be applied to each order the General Conditions of Sale in force on the day of the order.
Thus, the Buyer must be at least eighteen (18) years old, be legally able to contract and use this Site in accordance with the General Conditions of Sale.
Resale or distribution of products or services purchased at http://www.miel-des-abeilles.com is strictly prohibited without prior authorization or contract.
Article 2 – Availability of Products and Services
The products and services offered by the honey bee company are presented on its website in French. Any national of the European Community and of the countries complying with Directive 95/46/EC cannot claim his linguistic ignorance as a clause of cancellation of the contract.
The offers of products and prices are valid as long as they are visible on the Site, within the limit of available stocks. Article 3 – Geographical area

Article 4 – Order

Indeed, the "double click" associated with the procedure of authentication and non repudiation and the protection of the integrity of messages constitutes an electronic signature, within the meaning of article 1316-4 of the Civil Code.
Each command keeps track of the IP address
Any agreement of a quote sent by email to the Buyer, and sent to the company honey-of-bees.com with an explicit agreement also constitutes an irrevocable acceptance.
Article 5 – Ordering process
The Buyer wishing to purchase a product online must follow the procedure described below.

Article 6 – Order confirmation
Any order placed with the honey-bee.com company must be confirmed by the company before the order is finally accepted.
Indeed, the company miel-des-abeilles.com reserves the right to cancel any order of a Customer with which there is a dispute relating to the payment of a previous order, or other cases provided for in this contract.
The confirmation of the order will be sent by email to the Buyer as soon as possible, subject to the provision by the Buyer, of a valid email address not subject to any restrictions of use (business email address for example). In this case, the company honey-of-bees.com cannot be held responsible for the non-receipt of the order confirmation containing all the contractual information and carrying proof of the transaction. It is the Customer’s responsibility to set the level of spam filtering.
However, without contradicting the foregoing, as soon as the Customer settles his order by cheque, the order confirmation will specify a delivery period which will only begin to run from the final cashing of the cheque by the company honey-of-bees.com.
For traineeship bookings paid by bank cheque or transfer, the confirmation takes place on the day of receipt of the Cheque or transfer. The customer has a period of 7 clear days from the date of his order to send us his bank cheque or his transfer, failing which, the postmark (or the bank) being authentic, the reservation is systematically cancelled. The customer is then informed by e-mail.
Article 7 – Price
Prices are valid as long as they are visible on the Site, within the limits of available stocks. Honey Bee.com reserves the right to change the prices at any time and undertakes to apply the price in effect on the date of validation of the order, subject to the availability of the product ordered on that date.
Prices are quoted in euros. VAT-free, Article 293-B of the CGI applicable on the day of the order. They do not include participation in the delivery charges charged in addition and which will be indicated in the order confirmation.
Article 8 – Method of payment
The honey company of bees.com provides the Buyer with various payment methods offering maximum security and guarantees:
- By bank or private card (Carte Bleue, Visa card, Eurocard/Mastercard), indicating directly in the area provided for this purpose (entry secured by SSL encryption), the number of the card without space between the numbers, its validity date, as well as its control cryptogram;

The order will only be processed upon receipt of your cheque and after validation of the cash in question.
For the booking of internship, the client has a maximum of 7 clear days to send us his cheque. During this period, the reservation is temporarily accepted. After the 7 days following the order, the internship booking is cancelled;
- By wire transfer, by contacting customer service directly at Balou390@gmail.com. The honey-bee company.com will then send the Customer all the necessary information to proceed with the transfer. It is to be taken into account that any booking of internship awaiting transfer is granted for a maximum period of 7 clear days during which, the transfer must be credited to the honey account of the bees.
After this period, all reservations lapse and are automatically cancelled.
The Customer guarantees the honey-from-bees.com company that it has the necessary authorizations to use the payment method chosen by it, when validating the purchase order.
For bank card payments, certain checks may be carried out by the Bank Institutions: Crédit Mutuel. In the event that the contact details provided by the Customer are verified by the Banking institutions, the information relating to the Customer’s order is the subject of automated data processing, the manager of which is the Customer’s banking establishment and/or the bank card holder. The purpose of this automated data processing is to define a level of analysis of a transaction and to combat credit card fraud.
Honey Bee.com is the recipient of the data related to the Customer’s order. The non-transmission of data related to the order prevents the analysis and therefore the realization of the purchase.
The occurrence of an outstanding payment due to the fraudulent use of a bank card will result in the entry of the contact details related to the order associated with this unpaid payment in a payment incident file implemented by the company honey-of-bees.com. An irregular declaration or anomaly may also be the subject of a specific treatment.

Article 9 – Retention of title
The products delivered to the Customer remain the property of the company honey-bees.com as long as the Customer has not paid the full price in principal and accessories, due under his order. Payment within the meaning of this clause means the effective collection of the price by the company honey-bees.com.
However, the transfer of risks takes effect as soon as the products ordered are actually delivered to the online store.
The documents provided to the Client are governed by the Intellectual Property Code. They remain the property of the honey-bee company.com. It is therefore forbidden to reproduce, assign, or exploit the documents provided without the consent of the company.
Article 10 – Execution of the order
The company honey-of-bees.com reserves the right to refuse the order for a "legitimate reason" (as defined by the jurisprudence), and in particular (without this list being exhaustive) in case of unavailability of the product, of abusive demand of the Customer, presumption of impossibility for the Customer to contract or of manifest intention for the Customer to harm the honey-bee company.com.
The company honey-of-bees.com also reserves the right not to execute the order in the case of a manifest typographical error leading to the display of a «vil price», even after confirmation of the order addressed to the Customer. Finally, the company reserves the right to refuse the order in case of dispute with the Customer, total or partial non-payment of a previous order, refusal of bank authorization during the online payment process.

Article 11 – Invoicing
An invoice will be automatically sent to the Customer when ordering. This will be attached to the goods ordered and received by the Customer at the address indicated on his order.
Article 12 – Delivery
As a reminder, products purchased on the Site http://www. miel-des-abeilles.com can be delivered worldwide. However, it is the Customer’s responsibility to verify that the ordered goods are likely to be imported into the State in which they reside.
Products are shipped to the delivery address(s) indicated during the order process.
The Customer can consult the order tracking to know the progress of the delivery. The Customer is informed by email of the dispatch of the order. This email contains the address of the site on which to track the status of the shipment as well as the tracking number of the package.
In case of absence of the recipient of the order at the time of delivery, the carrier will leave a notice of passage and the Customer or the recipient has fifteen (15) days to recover the parcel according to the modalities indicated on the notice of passage. After this period, the order will be sent automatically to the company honey-of-bees.com who will contact the Customer again to define the conditions for a possible redirection. The processing fee for this new delivery will then be charged to the Customer.
Shipping costs are calculated based on the type of service chosen and the type of products purchased. Please refer to the delivery section of Honey Bee.com which provides a price comparison of the different carriers or modes of transport available.
Each order will be accompanied by a document (required by Article L 121-19 of the French Consumer Code) listing:
- Company identification and contact details;
- delivery costs
- the methods of payment and delivery
- essential product references
- the price
- the address to which to submit complaints
Any failure or delay of delivery greater than seven (7) working days must be reported to our Customer Service as soon as possible.
If you receive the product after the cancellation of your order, you will return it to us in its original state to allow us, upon receipt, to proceed with its refund.
You must verify the conformity of the goods delivered at the time of delivery and before signing the delivery order of the carrier.
You must indicate on the delivery note and in the form of handwritten reservations accompanied by your signature, any anomaly concerning the delivery (open package, damaged product, “the delivery person did not want to wait for the item to be unpacked”, etc.). This verification is considered to have been carried out when the Buyer, or a person authorized by him, has signed the delivery note.
Article 13 – Right of withdrawal
In accordance with article L121-21 of the French Consumer Code, the Customer has a period of fourteen (14) days (public holidays and Sundays included) to exercise his right of withdrawal without having to justify reasons or pay penalties with the exception, where applicable, a return fee. The period of fourteen (14) days shall run from the date of receipt of the ordered products.
However, the Customer will not be able to claim this right in the following cases:
- Provision of a service the performance of which has commenced or been completed, before the end of the fourteen (14) day period, with the express consent of the consumer;
- Supply of goods manufactured according to the consumer’s specifications or clearly personalised or which, by their nature, cannot be redirected or are liable to deteriorate or perish rapidly.
The honey-bee company.com recommends to the Customer who wishes to exercise its right of withdrawal to contact the customer service directly or by email to Balou390@gmail.com, or by telephone on 06.32.58.28.00 All the information necessary for the return of the goods (procedure, documents to be returned to the company honey-bees.com will then be detailed to the Customer.
Packages for which there is no information attached to identify the sender (order number, last name, first name, address) cannot be taken back.
The product or products must be returned in its original condition and packaging, complete and accompanied by a copy of the purchase invoice. The products must not have undergone any alteration.
The Customer’s refund will then take place within fourteen (14) days of the recovery of the goods by the honey-bee company.com
For the booking of internships, the client has this right of withdrawal until a maximum of 60 days before the start date of the internship. After this period, the sums paid are not refunded because it would leave too little time to put the vacant space back on sale. However, honeybee.com undertakes to do its best to return the space released to sale. If the free space is taken back, then honey bees.com will fully reimburse the retracting customer. Otherwise, there will be no refund of the amounts paid.
In case of withdrawal of a booking of internship, it is not possible to change the calendar of the reservation within 60 days of the departure of the internship.
For the products, the costs and risks associated with the return of the goods are the responsibility of the Customer who ships them. The return of the product(s) will result in a refund equal to the purchase price of the product(s) purchased (including the amount paid by the Customer in order to pay the amount of the delivery, and less any return costs incurred by the Customer).
Article 14 – Exchange, Refund (Non-conformity of the order)
In case of non-conformity of the order: reference error(s) or missing reference(s), the Customer may return the product(s) received. In this case, in order for the return to be accepted, the Customer must first inform the Customer Service, and return the products in perfect condition, in their original condition and packaging, as soon as possible.
The product(s) must be returned, accompanied by the purchase invoice, to the address indicated in section 16 hereof.
For the returned product, it will be refunded or exchanged according to your request and available stocks. If a refund is required, it will be made within thirty (30) days of receipt of your return.
Article 15 – Guarantee
Honey Bee.com is committed to meeting its warranty obligations for products sold on its site and in its various catalogues:
According to Article L.211-4 of the French Consumer Code, The seller is obliged to deliver a good in conformity with the contract and is liable for any lack of conformity existing at the time of its delivery.

The products sold on the website http://www.apiculture-formation.comare in compliance with the regulations in force in France.
Honey-from-bees.com does not guarantee to the Customer any harmful consequences that these hidden defects could have caused.
In addition, the liability of the honey-bee.com company cannot be incurred if the defect of a product or the damage caused is related to non-use and/or maintenance and/or storageConforms to the purpose of the product or if the damage is due to normal wear and tear of the product.

Article 17 – Force Majeure
Honey Bee.com cannot be held liable under any circumstances for the non-performance of the order in the event of force majeure. Article 18 – Cryptology

Article 19 – Electronic Signature
The "Double Click" associated with the procedure of authentication and non-repudiation of the Customer at the time of its order and acceptance of these General Conditions of Sale constitutes an electronic signature within the meaning of article 1316-4 of the Civil Code which has:

Article 20 – Liability
The company honey-of-bees.com, in the process of selling online, is only bound by an obligation of means; its liability cannot be incurred for any damage resulting from the use of the Internet such as loss of data, intrusion, virus, service disruption, or other unintended problems.
Article 21 – Evidence

Article 22 – Retention and archiving of documents
The archiving of transaction data is carried out on a reliable and durable medium, in accordance with Article 1348 of the French Civil Code.
It is therefore carried out in accordance with AFNOR Z 42-013 on the design and operation of computer systems to ensure the retention and integrity of records stored in those systems.
Article 23 – Nominative information

Article 24 – Intellectual Property
In accordance with the laws governing Intellectual Property (literary and artistic property rights, industrial property rights), this Site and all elements, trademarks, designs, logos, graphics, etc. found on this Site are the exclusive property of the company honey-of-bees.com and its partners, the latter not granting any license or any other right to consult the Site.
The reproduction or use of all or part of these elements is only authorized for the exclusive purpose of information for personal and private use, any reproduction and any use of copies made for other purposes being expressly prohibited. Any other use constitutes an infringement and is sanctioned under the Intellectual Property, unless prior written authorization of the company honey-of-bees.com.
Any simple link or hypertext is strictly forbidden without a written and express agreement of the honey-bee company.com.
Article 25 – Entire contract
These General Conditions of Sale express all the obligations of the parties. No general or specific conditions communicated by the Customer may be included in these General Conditions of Sale.
Article 26 – Non-derogation
The fact that the Company does not claim a breach by the Customer of any of the obligations referred to herein cannot be interpreted in the future as a waiver of the obligation in question.
Article 27 – Applicable law, Disputes
These General Conditions of Sale online are subject to French law, in accordance with European directives, notwithstanding any rule relating to conflicts of laws.
In the event of a dispute, the parties will favour amicable settlement. Any dispute concerning the interpretation or execution of this contract between the company honey-of-bees.com and a natural or legal person considered as consumer, will be brought before the French courts, in accordance with the provisions of Articles 46 to 48 of the NCPC.
For any contractual relationship of type B2B between the company honey-of-bees.com and a legal person, the assignment of the competent jurisdictions is entrusted to the courts of the registered office of the company honey-of-bees.com.
The visitor is informed that the site is visible without obligation to submit to cookies. However, in case of order on this site, the Customer has the obligation to accept cookies in order to allow a perfect synchronization with the management of the cart. In case of refusal, orders can only be registered by payment by bank cheque (drawn on a French bank or compensable in France) to the exclusion of any other. For internships, the receipt of a cheque may require time so that the internship may be complete before the receipt of payment.
In this case, miel-des-abeilles.com agrees to return the payment cheque as no booking is accepted by phone. Only receipt of the payment is taken into account
Final Validation is subject to payment collection.
Article 29 - Specific to the sale of swarms
As a professional breeder, the quality of swarms and queens supplied by honey-from-bees.com is subject to strict specifications based on the deep respect of natural laws.
The Swarms and Queens made available to the Customer, travel to the risks and peril of the customer as soon as he leaves the place of production.
The Customer acknowledges being able to ensure the best care, especially in terms of nourishment and treatments.
The Customer is informed of the obligation made to him to be registered with the Chamber of Agriculture, either under NO NUMAGRIT or NO SIRET.
honey-of-bees.com undertakes to deliver to the customer on the agreed day, swarms and queens in perfect sanitary condition. As such, honey-from-bees.com hand-delivers to the customer, an invoice of purchase acquired, a certificate of good sanitary condition as well as a traceability sheet on the provenance of the swarms.
honey-bee.com provides declarative documents on the production of its swarms, in particular to the services of the DDPP.
As soon as the swarms are taken over, the Customer is solely responsible for their life. Under no circumstances can he turn against honey-bees.com in order to obtain any compensation of any kind.
Delayed provision of swarms
Swarms and queens being produced by natural means, honey bees.com would not be held responsible for any delivery delay related in particular to weather conditions or natural events prohibiting production.
honey-of-bees.com undertakes to inform the Customer of the evolution of the situation as soon as it is put into production.
The availability dates are forecast dates. These dates become final only after the validation of the compliance of the queens. It is then sent to the Customer, an e-mail informing him from when he can take possession of his swarms and queens.
The Customer is informed of the 3 possible dates for the removal of the swarms which is by appointment. In the event of an absence from the appointment, miel-des-abeilles.com reserves the right to charge a babysitting fee and, in the event that the new deadline is late, to charge for the hive return service.
Crossing and Interbreeding
Although the fecundation of queens is produced on a specific apiary, honey-bee.com cannot guarantee absolute purity of fecundation until the legislation prohibits the importation of non-aendemic bees.
The original honey-bee.com strains have been authenticated as belonging to the species Apis Mellifera Mellifera Linea eus 1758, called Black Bee. Offspring were selected to preserve the species.
When ordering swarms or queens, the Customer pays a 50% deposit if he orders by post accompanied by a bank cheque or in full if he makes his payment online. The order balance is adjusted to the provision of swarms.
Swarms and queens are intended exclusively for repopulation in the National Metropolitan France territory. In case of establishment in any other country, the customer becomes solely responsible in all, especially during customs checks.
In order to be in good standing, it is up to the customer to specify at the time of his order, the complete list of documents that must be provided to him to support the swarms. honey-des-abeilles.com, will then prepare a specific estimate for the additional costs and costs incurred, including mandatory veterinary checks and the quarantine period(s), additional administrative work, etc.
No document can be required later if these elements are not legibly named and listed on the order form.
honey bees.com reserves the right to refuse orders from swarms and queens to foreign destinations without having to justify itself. In the case of an order registered through a direct payment by credit card, honey-des-abeilles.com will refund the full amount paid within 7 days. Transfer of ownership. The Customer becomes the sole owner of its swarms or queens as soon as they have been delivered to him by honey-of-bees.com.
